Recientemente se ha anunciado el proyecto de Ley de Sala Cuna Universal, mediática iniciativa impulsada desde el poder ejecutivo que permitiría a todas las mujeres que deseen participar del mundo laboral acceder a este beneficio. A pesar de existir bastante consenso sobre la medida de equidad que incorpora esta noticia, permitiendo incluir a todas las mujeres cotizantes (dependientes e independientes) y con independencia del tamaño de la empresa, además de extenderse a mujeres y hombres o personas a quienes el tribunal les otorgue el cuidado de ese niño o niña, nos parece relevante incorporar en la discusión pública ciertas tensiones que se levantan.
En primer lugar, resulta necesario preguntarse sobre el beneficiario de la iniciativa, donde se ha planteado desde el oficialismo que el propósito principal de este proyecto es “eliminar las barreras para potenciar el empleo de las mujeres”. Sin embargo, ¿en qué grado beneficia a los niños y niñas menores de dos años?, ¿por qué sólo hasta los dos años y no hasta los tres años?
Paralelamente, hemos celebrado aquellas noticias orientadas a resguardar los derechos de niños(as) en una política de infancia, por tanto, ¿cómo coexisten los derechos de niños y niñas a desarrollar su bienestar psíquico y emocional, a cargo de un cuidado exclusivo de sus figuras principales de apego, versus el derecho de las mujeres a participar del trabajo?
Sólo 34 países cumplen con la recomendación de la Organización Internacional del Trabajo (OIT) de conceder, al menos, 14 semanas de licencia a la madre. Se destacan las experiencias de Reino Unido (315 días de permiso), Noruega (315), Suecia (240) y Croacia (410) que han privilegiado resguardar el derecho de los niños a vincularse con sus padres (o adultos significativos), en una etapa crucial del desarrollo humano que lo requiere. Por tanto, una medida vinculada con la infancia debiese procurar generar las condiciones que permitan proteger el empleo de las madres y padres, promover la flexibilidad laboral necesaria para atender las necesidades de cuidado y afecto de los niños y niñas y, al mismo tiempo, ofrecer a los niños y niñas el derecho de satisfacción de sus necesidades.
Un segundo punto se refiere a la cobertura y calidad. Actualmente, según la Subsecretaría de Educación Parvularia la sala cuna (nivel de niños y niñas menores de 2 años) atiende a un 36% de niños y niñas, sin embargo, ¿será necesaria su obligatoriedad? Esa es otra señal altamente delicada y alarmante hacia las familias y comunidad. Habiendo consenso en que los primeros y más importantes educadores son los adultos familiares, y que los primeros años son vitales para el desarrollo humano, se recomienda alejar lo menos posible a las guaguas de dichas figuras, y que la alternativa de una institución educativa para niños menores de dos años sea una medida de excepción que debe llevarse a cabo con el mayor de nivel de calidad.
¿Estamos garantizando hoy al 36% de los niños y niñas que asisten a centros educativos para la primera infancia esas medidas de calidad? Se han realizado considerables esfuerzos en mejorar las condiciones de infraestructura, no obstante, aún falta seguir avanzando en múltiples dimensiones para llegar a los niveles deseables que permitan asegurar ambientes de bienestar y aprendizaje. Por otra parte, es preciso fortalecer y avanzar en la calidad de la formación profesional inicial y permanente de las y los profesionales de este nivel educativo.
Se requiere tomar ciertos resguardos que permitan avanzar en ciertas acciones de equidad, pero integrando los derechos de la infancia con los derechos de las mujeres trabajadoras, con alternativas que ofrezcan mejores oportunidades para todos y todas, presentando diversas alternativas para las familias y no medidas impuestas (algunas madres y padres acceden o retornan al mundo laboral no por opción en desmedro de la crianza exclusiva, teniendo que tercerizar esta tarea).
Se ha planteado adoptar el modelo francés donde un adulto cuida a un grupo de niños en casa, también ello se ha dado en otros países en América Latina como Colombia. Sin embargo, en Chile desde 1944 en la Universidad de Chile se cuenta con educadoras de párvulos como profesionales universitarias, aportando con un saber pedagógico especializado e instituciones formadoras. En nuestro país, tener expertas y expertos en educación para este grupo etario podría ser una solución alejada de la calidad el contar con personas que sólo dieran cuidado y no estén especializadas en una edad tan vulnerable, delicada y relevante que marca hitos para toda la vida como es el desarrollo de la personalidad, autoestima, cerebral, u otros aspectos esenciales.
El cuidado, atención y acompañamiento educativo de los niños y niñas durante la primera infancia pueda darse en diferentes modalidades, como hasta ahora se ha dado, pero bajo el alero de instituciones de reconocimiento nacional como es la Junta Nacional de Jardines Infantiles y Fundación Integra. En este contexto, ¿quién desarrollaría esa capacitación o certificación? ¿cómo se resguardará la equidad y calidad? Sería relevante no olvidar que hace más de setenta y cuatro años en Chile contamos con educadoras de párvulos a nivel universitario para educar a los niños y niñas desde el nacimiento hasta los seis años y en el caso de las guaguas especialmente, cuando los adultos familiares deben de trabajar fuera del hogar, acogerse a este beneficio.
